If you're referring to time limitations, then no, the clock does not move with a new assignment, the clock is static. If not, they would just sell on the "book" every few years to keep resetting it....
-
Also, remember that Felicitas was dissolved in 2022, so it wouldn't be possible to make a delayed payment, as they wouldn't be a valid company to make payment too.
Also, if they acquired the book in late 2022, why wasn't it present in the 23 and 24 annual accounts.
This is...Last edited by MrO666; Yesterday, 12:49.

That means that's a debt that the company owes which it needs to pay within one year doesn't it, not that the company is "owed" ?...

My error, I was looking at another of Kennys companies, West 28th Capital Ltd....

Interesting...........
So, who sells a genuine loan book for a few grand that is worth 10's of millions..........nobody does...........

I agree, but don't make the mistake of thinking they're not serious.
I believe their argument will be very weak, but people need to make sure they defend against it factually and without emotion. Remember, if they want to bring a claim, the burden of proof is on them to evidence that the...

I'm not sure I'd be classing Trethowans as a top tier law firm.....not exactly Linklaters or Clifford Chance are they.
I was doing some maths last night. Lets be conservative and say West 28th are going hound 500 people for £50k each, that's £25m (I'm sure the number of people and figures...

Exactly....so if they want to claim CCA........then they have to also accept the 6 (5) year limitations that come with that. They can't pick and choose.......although I suspect that's what they're going to try and go.
If I were impacted by this, I would be going through every email and...

Remember that any legal firm will be charging healthily for this sort of thing, regardless of outcome.....so in some respects they won't care.
Even if they did manage to convert it, many people would still be able to use the limitation argument.
The person who shared the original...

Who exactly have they indicated to that they're preparing their claims (which could run into 100's of individual people) ? I'm sure they'll try something, but if they honestly plan to take hundreds of people to court, then this is going to be big news.
To bring any valid claim, they will...

If they have settled and have agreement in writing from Felicitas (or a previsous), I doubt that West 28 are going to try to pursue those individuals, as it's not worth it.
Claiming someone owes money is one thing, claiming someone who had settled on a full and final basis still owes money...

Equally, if someone makes a SAR, but then West 28th subsequently relay on a document or email that was not included in the SAR response tot he requestor, I wonder how that stands ?...

I'm led to believe though that a SAR request only ever produced the questionable documentation as you say. How about all the emails etc that Felicitas sent to people......why has none of that been produced as part of a SAR ?...

What I would like to understand is what information was passed from Schemes > Felicitas > West 28th.

Just remember, if they want to claim CCA, then they also need to accept that puts everything firmly into the scope of limitations.
Someone shared with me an email from Felicitas to them dated "just" over 6 years ago demanding payment in full. It would be down to West/Trethowans...

I'm sure a court would like to take a view on how they are trying to claim that "payments" made under IoM Deed Trust law are now suddenly subject to English CCA laws instead, all without ever contacting the alleged borrower....

This is what doesn't sit right with me at all.
Elysium knew about those letters being sent before any recipient did......I can't work out why that would be the case, unless they're far more involved than they claim to be.
I've discussed this (casually) with a friend who works...

What sort of money are they asking for to "fight" this now ?...

Agreed....it's all a game isn't it.
I expect the next letter will be a demand for payment, which would be interesting, as I believe many people were issued "final demands" a number of years ago.
For those affected, please try not to get too stressed or worked up over...
