    In my opinion (which arguably counts for little), at this stage I would be pushing this myself. As has been said many times now, formally request all paperwork from West 28 / Trethowans etc which they are relying upon to bring this claim, until they produce that, there isn't any way of them or anyone...

    I know of multiple people who settled for 1p in the £ when this was all with Felicitas.

    As you say though, this comes down to how greedy they are vs how strong they genuinely feel their case is. Clearly only a fool would pay full asking unless a court told them to, so unless they honestly...

    I agree entirely with what you're saying. People should not just assume litigation will never happen.

    There are so many schemes and I would guess that some might be seen as potentially stronger litigation cases than others, so agree that it's worth being sure...

    I'm with you on this one, I can't see them going for a NWNF approach, but regardless what approach it is, Trethowans are doing everything they can to avoid providing information to people that they're legally entitled to.

    1) An FCA registered business can engage in the collection of CCA regulated debt only if t explicitly holds the "regulatory permission for debt" permission.

    2) An FCA registered business can engage in the collection other debts providing that the debts are explicitly not CCA regulated....

    Totally different tack here, but I wonder what the FCA would think about an FCA Registered Company (Ethica) trying to enforce repayment of an alleged loan that is being falsely claimed to be under CCA Regulations, and where the alleged loan owner refusing to provide any evidence to substantiate that...

    And also, you want a genuine copy of the deed, not the branded letters that Felicitas etc sent out, but an actual copy of the legally binding Deed of Assignments in full......every one of them from the original trust to West 28th....

    I am now aware of two people receiving these letters, and interestingly one was sent Tracked 48 Hour, the other via normal Royal Mail post.

    I'm waiting for copies of the actual letters to be sent to me, but one thing I have been told is that for both people, whilst the letter is a "Payment...

    Who knows where this will all go, but one thing is for sure, if they genuinely try to make demands, this is going to take many years and lots of money, as this would all head to the big boy courts, not some local magistrate.
