    As many has said forget everything about the legalities/method on the scheme, forget HMRC, those who are not wanting to ignore this need to focus on the matter in hand and that is dealing with the debt dispute.

    This post goes into the details of the why and wherefores.

    It's a considered outrage for sure but it has to be dealt with.

        I suspect the 50% figure is in the hope it scares someone into paying that

        because as you say all the likely payers have already paid
        merely at clientco for the entertainment

            But for the debt to be valid all the paperwork including all the reassignments need to be valid and no-one on here believes that’s possible - it might be but we’re that the case Felicitas wouldn’t have been accepting 1% offers
            merely at clientco for the entertainment

              it's the other way round we think. Felicitas acquired the loans (sold on by Trustees etc., read the thread it's still in dispute how they got the schemes) they then use debt collection agencies to collect. They used Gladstones last time around (dropped them), they then used Statutory Demands through another third party solicitor. This time around they have used another debt collection agency .

              No one has bought these load debts yet.

                However Felicitas solutions ltd has an active proposal to be striken off. So the debt needs to be transferred somewhere

                  It's very straight forward in my eyes:
                  • Ignore
                  Or
                  • Refute their allegation in writing
                  • Request all the data they hold on you via a data SAR (Data protection laws require them to respond within one calendar month).
                  The second option will allow you to pick the bones out of what they supply assisting you in making an informed decision. I presume most people who do a SAR will then revert to ignoring them as there is nothing to answer to.

                  They will be expected to prove the alleged loan exists and they will also be expected to prove the deed of assignment from the original lender to all prior lenders is legally binding, including copies of all notifications making people aware.

                  IMHO it will go the same way all the previous attempts have gone.

                  Amateur QC's need not respond.

                    We did the second part(s) basically not ignore. One thing to say about them they are very organised and their paperwork has everything in great details.

                    Their proof of owning the loans was in part vague, in other parts confusing but they had proof.

                    It went away last time and now it's back.

                      I've ignored it to date as they have never provided any paper work up front ... not a thing, however, on this occasion I'm going to do a data SAR to see if they actually have anything to share .. and if so ... what!
