Exactly. What I would do now, having ascertained the agency need this information, is tell them that they won't get that information until the invoices are paid, since they have absolutely no right whatsoever to withhold payment for this reason. Further, if the money isn't in my business account with (e.g.) 5 days, then I won't be turning up to client site, and will inform the client of the reason.

Quite. The sort of behaviour that would makeOriginally posted by BolshieBastard View PostThe agency shouldnt be witholding payment until you provide this. Id be more than surprised if there's anything in the OP's contract that allows them to do this mid contract and especially after they've made several payments.
If you refuse to provide the info all the agency has to do is inform hmrc that you have refused to comply.mea bolshie contractor want to dig their heels in.

Neither your DOB nor your NI number counts as sensitive data btw. Data Protection Act 1998Originally posted by achilles View PostHi all,
The agency have demanded mid-contract that I give them either my date of birth or national insurance number. This is sensitive data that I do not want to give unless I have to. They say it is for compliance with the Regulations 2015.
They are actually withholding payment until I sent it to them.
Have you had similar requests from the agencies you are working with? What should I do?
Thanks
A

Your Co's number
There may well be some clause in your contract that says that you have to provide any statutory reporting info. Or you could consider the fact that they will be sending the info they do have and highlighting that you refused to provide the rest to HMRC in order to avoid the fine.
Time to suck it up I'm afraid.

Ok, thank you for your answers, I'll just have to provide what they want I guess.

Absolutely this. Don't even have search on here. A 20 second Google Search would have answered the question.Originally posted by TheCyclingProgrammer View PostHave you even bothered searching? This has been asked several times in the past few weeks.

It a reporting requirement on the agcencies, they have to collect it and provide it to HMRC. Your only option is to hand it over or walk. But you'll just get the same thing in the next gig.

And next time try doing a search before asking. This has been a well discussed topic recently.
