    Agency demands DOB or NI number

    Hi all,

    The agency have demanded mid-contract that I give them either my date of birth or national insurance number. This is sensitive data that I do not want to give unless I have to. They say it is for compliance with the Regulations 2015.

    They are actually withholding payment until I sent it to them.

    Have you had similar requests from the agencies you are working with? What should I do?

    Just got asked for my NI number, they're being asked to get those by the scumernment but DOB should not be necessary

        It a reporting requirement on the agcencies, they have to collect it and provide it to HMRC. Your only option is to hand it over or walk. But you'll just get the same thing in the next gig.

          Yes. They need to report following details or they get fined;

          Your name & address
          NI number or DoB_and_Sex
          Your UTR
          start & end date
          How much you were paid
          Your Co's number

          There may well be some clause in your contract that says that you have to provide any statutory reporting info. Or you could consider the fact that they will be sending the info they do have and highlighting that you refused to provide the rest to HMRC in order to avoid the fine.

          Time to suck it up I'm afraid.
