W28 are hedging their bets claiming they're CCA regulated ... if a claim made it to court a judge would rule on it ... if the judge rules its not CCA W28 will just pivot!...
-
There are very good reasons why they have signposted certain solicitors and it’s not quite the conspiracy theories most have suggested.- W28th costs fall. One negotiation with a firm covering dozens of people is far cheaper than a thousand separate disputes and court files.
- The outcome becomes predictable.

Only a moron wouldn't dispute it ... if left unchallenged it will follow due process and end up a financial burden!
Apathy will bite some people on the arse!...

Worth reading your early-2020 Felicitas letters closely before relying on them for limitation. The “Payment Demand” that came with the Gladstones covering letter, in mine at least, was a demand for accrued interest only. It expressly said Felicitas reserved the right to demand the capital later, on...

If anyone does have the West28th deed of assignment I'd appreciate a copy of it ... Obviously with redacted personal info.

I'm not sure what position others are in, but I've yet to be given a complete, end-to-end chain of assignment. What's been sent to me over the years has been either incomplete or missing altogether.
Their letters say the assignment to West 28th is dated "on or around 22 September 2022"...

S.77 request going in ... It forces them (Within 12 days) to produce the documentation they rely on ... whilst they don't comply their claim is unenforceable.Last edited by shampoo; 12 October 2026, 08:37.

For all the rabbits in the headlights ... whatever you do, do not bury your head in the sand and ignore the letters/demands ... because if it does end up in court and you've done sweet FA it will be too little too late ... and if you completely let it ride you're going to end up with a financial problem....

It depends how much the claim is for … under £25k is fast tracked....

If any of these went to court: how the CCA question would probably play out
(My own reading, not legal advice. Get your own advice on your own situation.)
A lot of people are rattled by the CCA language in recent letters: "credit agreement", statutory statements, default...Last edited by shampoo; 8 October 2026, 13:37.

Fair point on the distinction, and it's why I listed them separately rather than presenting them as one line of authority.- Bates and Sheth are First-tier Tribunal (Tax Chamber) decisions. They're about tax, not whether a debt can be enforced. They're relevant only for what the tribunal found about

The alleged loans were "never meant to be repaid": what the independent sources say
Lots of us have said for years that these advances/discretionary payments were never meant to be repaid. Here are the independent sources that point the same way, so you can read them yourself....

Let’s see what arrives in the post today/this week!
Multiple SAR’s submitted along with an ICO complaint (ICO are a waste of space).
I wonder if they’re going to test a few files in court this side of Christmas?
Anyone on here received a full chain of assignment...

Whatever the limitation period is, for example six or twelve years, it is important to understand exactly when the time limit started. Under the Limitation Act, time starts to run from the ’cause of action’.
The ’cause of action’ is the million $ question which is detailed in the alleged...
