There isn't a criminal/HR investigation every time this happens. If someone does comment on a strong accent it could, technically, fall under racial harassment but doesn't meet the spirit of the rule to protect people from being treated badly so it could be dismissed if a complaint is put forward. I have a horrible feeling that because it's got the word race in it every occurrence could be pushed through to EAT and the companies can never win.
