Basically, The Court of Appeal ruled that certain contractor loan debts were transferred improperly, so the transfers were legally invalid and the debt purchasers may never have owned the loans they tried to enforce........end...

.......and if they're deemed FCA loans, then they will also be 100% bound by full FCA rules......which means many are statute barred.
I have seen demand letters going back to early 2020, so on that front, they would be out of luck.......can't have it both ways.

Also, if someone disputed any claim back in 22/23 when W28 first tried it on, then that's perfact defense should you suddenly receive a SD, as i'm sure there's no legal basis for sending a SD for an alleged debt that's already in dispute....

I'm also very suspicious of these laws firms, and have been from the start.
Yes we know W28/Trethowans are going to try something, but again, a dispute does not need to come from a solicitor.
If it were me, I'd ensure that all my paperwork was in order, and if I needed to,...

I don't think they're made a mistake at all. I think they know exactly what they're doing, and they're just trying a different angle. If they're going to claim CCA, I don't think they would then go "oh, sorry we meant speciality". Neither...

To start with, deciding to change an IoM governed EBT based specilaity debt into an English governed CCA 1974 regulated consumer loan is FAR from simple, and for that to be done without any consultation or contact with the alleged debter would, I believe, pose a serious problem for W28 if this went...

Just to throw this one out there, but you don't need to wait for any form of demand to land before formally disputing that any debt exists.
The fact Trethowans have sent letters detailing what they perceive to be a debt, means you can formally dispute it right now. That in turn creates...Last edited by MrO666; 18 May 2026, 07:52.

If you're referring to time limitations, then no, the clock does not move with a new assignment, the clock is static. If not, they would just sell on the "book" every few years to keep resetting it....

Also, remember that Felicitas was dissolved in 2022, so it wouldn't be possible to make a delayed payment, as they wouldn't be a valid company to make payment too.
Also, if they acquired the book in late 2022, why wasn't it present in the 23 and 24 annual accounts.
