They'll probably tell you loads positive eg. they're confident the scheme is fully compliant with the law, it was approved by tax counsel and HMRC have got it wrong.
We've heard all that before over the past 20 years, and not once has a scheme succeeded. Not a single one of these schemes...
1) On what grounds are the penalties being appealed?
2) What reasons did the FTT give for finding in favour of HMRC?
3) Which tax firm/solicitors are running the appeal?
4) Which barrister are they using?

I suspect the providers of these current schemes have designed them to fall outside the scope of the Loan Charge, although whether they've succeeded or not is another matter. It's also hard to see how any payment mechanism these days can get past the beefed up DR legislation....
There would almost certainly be something on your tax returns which would give the game away to HMRC eg. name of the employer. Also, the tiny salary would be a dead give away. The people you worked with are naive if they think the only way HMRC would find out is if someone blew the whistle on it....
I have been saying this every year for the past decade or so. There never seems to be a shortage of crooks willing to peddle these scams, and sadly no shortage of gullible punters for them to prey on.
