From memory I think the fines arrive thick and fast if you don't pay up very quickly once the payment notice arrives...

Hence if you need to source the money to pay its probably worth getting things into motion sooner rather than later.

Exactly.......what they think you owe and you do owe are probably wildly different........

I've been led to believe that the chances of coming to an amicable agreement / plan (once figures are agreed) is more likely if you're the one instigating it, rather than HMRC banging on your door and you hiding behind the sofa.

I've already agreed figures with HMRC, because if it does all come on top, I can agree a course of action straight away, without the need to horse trade over the numbers. I'm in as good a position as I can be should the worst happen. If HMRC do get their powers, I'll just get the business done, I'm not interested in fighting the establishment for years, incurring interest and yet more penalties, and then probably still getting bent over on a technicality.

Remember people, APN's, followers or whatever else comes along, the end game is still that HMRC don't think the Sanzar scheme was valid. You can fight and argue all you like, but if HMRC want to go to court (who knows if they will), you've either all got to stump up some serious money for a fighting fund or pay the tax. Sanzar are long gone, and don't expect Cobham to do us any favours. They will happily put up a fight if we pay them, but ultimately they get paid win or loose.......

mmm this is interesting. To be fair, the numbers they have supplied me with have been pretty well bang on. So I'm not really sure how they could be more amicable.

They have no idea if Sanzar is effective or not; they have a view that all EBT avoidance schemes are ineffective, but they're hardly likely to have another view. It always surprises me that they haven't taken at least one of the contractor related schemes to an FTT. For example: they nail Edge and then use that as a stick to beat other schemes.

Still, once the APN/FN arrive - you either pay or start looking forward to penalties for non payment.....

I wonder how many on there have open enquiries going back 10 years, but have never received anything more from HMRC (other than the initial enquiry letter) and don't know how much (accurately) will be asked for, level of interest requested etc. ? I understand that sometimes they are accurate, other times a fair way out.

It's becoming better by day! 6 years ago NTRT members were in focus, today DOTAS schemes, and what is next?

Why does HMRC wants to call limited companies as Personal Service companies? Does HMRC say a limited company with single director or couple directors with single client is GENERALLY tax avoidance? Investigate these question and you know what is coming next!

To be a contractor and have MULTIPLE clients I am thinking of this business - Ask all contractors on PAYE to get same all tax paid PAYE income from my company. But my company uses a scheme. HMRC gets paid upfront on tax my company scheme saves. My company fights the battle in court. If my company win, contractor gets a % of winnings. Nothing for contractor to loose as on PAYE he has paid all tax but a chance for a bonus tomorrow if HMRC lose. Every coin has a flip side and it will be late by the time HMRC knows this.

Point being all on PAYE will not solve the problem
