Under the UK law, they're not committing murder.
Now, under the law of johnny-foreigner, they can pass a law saying that if a foreign national kills one of their own, it's murder. But in neither case is it legally state-sanctioned murder. You do realise that that wasn't why they did it, right? Even in WW1 when most UK soldiers were volunteers, "protecting free speech" was not the reason they wanted to fight.
