          A company keeping data it owns doesn't come under either of those. They will have retention polices as a minimum on top of any extenuating circumstances. The public sector haven't been able to close accounts and delete data since the beginning of operation Yew Tree looking at the historical abuse by politicians. I left a client and went back 3 years later and it was like I'd never left. The number of re-occurring meetings that were still going was an eye opener. Took a good couple of hours deleting all the general mails and meeting invites to get a clean mailbox and start again.

          The employer is also legally obliged to keep the ex employees data for a period of around 6 years in case there is any employment tribunal or other things raised for a good period after they leave as well. You can do a SAR but you can't do be forgotten.
