That is mad, based on the facts presented to this forum I cannot see how the Judge can decide for retrospective legislation. Especially since HMRC sat and just kept things in limbo for 8 years until they can find/dream up a method which they think makes the trust income all taxable. I strongly wonder if some other behind the scenes influence has been brought on!
More waiting and delay, more interest. Yeah fine make it prospective but don't make innocent people pay for civil service incompetence!
Sounds and looks to me that someone got to the judge. . . There are massive implications to the outcome of this for HMT. Would not surprise me if anyone was lent on. . . .
