Just got back from the court room. The judge sat down, said straight out "I dismiss the case for judicial review". He then went on to say he wouldn't hear an appeal in his court.
HMRC guy asked for costs.
Our guy wnet on to register an appeal (somewhere???) and highlight the potential future prospects for retrospective legislation and HMRC.
