Reading on statute of limitations
They are not normal loans, my deed states it is a specialty loan (along with other limitation extending wording) which means 12 years limitation, not 6.
unless, they are converted to that CCA agreement, which is impossible without our agreement....

A creditor cannot simply convert an old loan into a new, fully compliant CCA agreement without your agreement.
- so if we never sign anything, it’ll never become a CCA agreement.

Trethowans have, and initially, they don’t need to take 100’s to court..
I’ve found the deed, and from what i have now read, i now understand and agree if they are turning these into CCA rather that the original specialty debts they might be doing us a favour?...

I think due to speed of required response if they go ahead with the claims (which they have clearly indicated they are preparing, including their strategy, which as you can guess is skewed in their favour).
My understanding is a claim would need to be responded to within 14 (or 21) days....

Not sure how much i should say in this forum but in short: from my skimish reading as theres a lot to digest. Elysium we’re attempting to resolve all of this with them, given the arguments we all know, but recently West 28 have changed tactics (from ignoring/ stalling to legitimising)...

Agreed, but I’m probably going with Elysium for now as i do believe we’re about to be put in a position that will require defending. And i’m not quite ready to go solo.
