      It's been us, supported by a QDOS review and the client agreeing.

      But yes, educating them that we are liable has helped.

          So if the final legislation changes liability, what's the situation then?

          Does anyone know when the final legislation is due to be published?

            I really can't see the sense of splitting the decision from the liability. I can see the outside decision for some contractors becoming a pyrrhic victory as their agency goes bust when HMRC makes an example of it.

              Put it this way, a lot of agencies I used to use would no longer be on my list. You will need an agency that is both competent and suitably sized.

              The typical back bedroom agency that does cl1 contracts isn't something I would want to be working through.

                I wonder what Andy and the other competent agencies are going to do when they discover that the clients are lining said agencies for a fall just to get the contractors to stay/take the contracts.

                ...and when client education fails to work because the client isn't the entity to get into trouble with HMRC.

                  The final legislation won't change the liability point, it may introduce a 'duty of care' from what I am told.
