Is this possibly due to those making the determination (assuming these are being made by the end employer) are not necessarily going being held accountable if subsequently the decision transpires to be incorrect? -

I really can't see the sense of splitting the decision from the liability. Put it this way, a lot of agencies I used to use would no longer be on my list.
