    Agree, seen this before, the numbers are made up, or high level estimate based on your income, with some assumptions, so they can open a case, with the case open so they can continue an investigation or review in detail based on your responses.

    If they hadn't, they couldn't have gone back again.

    I declared everything and settled a few years ago, they then came back 2-3 years ago saying I missed something, I checked and I had declared everything and just showed them that I hadn't from my settlement documentation (via registered Post with back up via email to them), I never heard from them again.

    Just work out the quick maths yourself , If XX/XX year I got loans of XX, for XX/XX year I got loans of XX.... add them all up, take approx 45% of this figure as to the tax you didn't pay on the loans.... compare this number to what you might have already settled with HMRC . If its way out, then HMRC are after the balance, if not, just send in all your previous settlement documents etc.
    Remember, they are doing this to make us do the donkey work, not them. We need to prove their number is wrong

      I’ve gone back through all my paperwork and I did declare everything back in 2019 when I settled. The payments came from a different name on my statements, not Birling, which is where I think the issue has come from. I’ve sent off all evidence again. Don’t expect to hear back anytime soon if last time is to go by.
      I was on one of these schemes for less than 4 months in total back in 16/17. How all these years later it is still biting me in the arse I don’t know.

        Out of my depth with all this! Having been stressed by Felicitas for 18 months back in 2020 for them to dissapere only for W28 years later Jan 2023 writing to me (same as Felicitas) I have rejected both companies demands and paid nothing.
        Now why on vacation my daughter gave me the news that HMRC have assessed that I owe them 48k to be paid by 5th May!
        I contracted with Winchester between Feb 2013 until March 2014 believing all was above board (I'm a complete novice when it comes to financial/tax etc) I basically left it to them to do what was necessary.
        I now find I'm like a small fish in a large ocean not knowing which way to turn or what to do!
        I retired end of 2014 not worked since then. I just don't have 48k under the mattress.
        Any advice/ help for the stressed out novice would help

          There's two separate issues here I'm afraid. HMRC now want the tax you avoided by working through a tax avoidance scheme between February 2013 and March 2014. One way or another you'll have to settle with HMRC but that doesn't have anything to do with the loans you have outstanding. Many people here have faced this situation, so you aren't on your own.

            I am aware these are 2 different issues. With W28 heard nothing since Jan 2023 1 letter only didn't respond!
            It's how to handle HMRC...SA is my current concern as only have to 5th May! to respond!

              Personally I'd contact a specialist tax advisor and at least pay them to look at your affairs and confirm whether what HMRC are claiming is correct. They can also deal with HMRC on your behalf, but of course they'll charge more for that.

              Assuming you & HMRC come to an agreement on how much you actually owe them, they should be happy to agree a Time To Pay schedule where you pay a certain amount back per month. They take your income and outgoings into account and propose payments you can realistically afford.

                What surprised me is that HMRC in one of the documents they sent not only had Winchesters name as company perceived to have paid me the "loans" but also the exact money paid to me. How would they have obtained that?

                    PLZ dont be naive, Winchesters will have provided the HMRC all the info they have on you and all the others caught up in this mess - it would be part of the agreeent between HMRC and Winchester.

                      Unfortunately you simply pay the tax that you were trying to avoid, these were not loans it was simply a method to avoid paying the income tax (we all know thats the truth) - this is what i did for the years 2008 till 2014, painful i know but thats life.

                      Make sure that the HMRC has all the facts and are charging you the correct amount so worth checking with tax guru then ask for repayment of 5-7yrs thats what i did.

                      Sorry for being straight but it's easier to deal with this way.
