          Under normal circumstances you're right but don't forget you could have a couple that have been happy together for 20 years, built up a life together, 'joint' assets etc etc, then one of the couple finds out they have a terminal illness. The law here would result in all those joint assets, and anything held by the dying individual, to be added to their estate and IHT be applied.

          If there is a will then the surviving partner should get the residual after tax (assuming the estate is large enough to be hit by IHT) but if no will, or there are greedy relatives, the surviving partner may have to fight for what they have built up together.

          This is a perfectly valid reason to marry for tax reasons and happens quite frequently.

          All I would say to everyone on here is make sure you and your partners wills are up to date and valid. Because as Vetran said previously, even when married it's a pain to deal with probate etc, if you're not married it will be an absolute nightmare.

            Friends of ours had been together >30 years, we had always assumed they were married (when we met them they had been a couple for decades) but when the Man contracted cancer we were invited to the wedding they had mainly to sort this issue out.

            If one of you does get sick pop down to the registry office and renew your wills especially if you have kids. Friends who were cohabiting and lost their partner will attest this is the easiest way.
