No it always brakes ok just sometimes (once or twice in two years) the car started to speed up suddenly as if the lane is empty.
Both times were near foreign trucks so I'm wondering if they had extra equipment on them like speed detecting or jamming devices.

Now the questions are after an investigation by experts will the conclusion be that if a human driver was in charge would the accident be probable? Then would it be likely to happen multiple times with different drivers in the same situation? If Tesla upgrade (and probably recall all their cars) would a similar accident happen again?

The real point is Tesla, Mercedes & Google will all have accidents and then fix them once and for all.
Humans make the same mistakes again & again even a series of different ones, we can't upgrade them.
According to the news was a sensor failed due to the bright sky.
The problem is the delay to fix the problem and recall the cars. There is a well-known problem in the hand breaks (in almost all models) that it's causing several injuries and accidents, the last one cause Anton Yeltchin's death.

Is this going to be a software or hardware fix? If Software I imagine Tesla can do it fairly quickly.

Is there no sense in any of this?

                      .
Why have a large lever for the handbrake when you can have a button?
Nowt wrong with electric handbrakes, they're a simple and reliable piece of tech.
Not sure about your gear comment, you're either in Park when you can't move or drive when you can?
