The fact is, he was on autopilot mode with crap technology.
The other thing not noted is that there are other external factors that may be at play. I have a Mercedes with radar based cruise control. Apart from ******* with Audi or BMW cars that think a 60 foot breaking distance gap set by my cruise control is there to be dived in at the last second, on a few occasions I have also seen the car inexplicably speed up presumably due to other road users having radar jamming
equipment running. Even though I use it almost all the time on any motorway I am always remain in control as I can't trust the other idiots using the roads.

      FTFY

Now the questions are after an investigation by experts will the conclusion be that if a human driver was in charge would the accident be probable? Then would it be likely to happen multiple times with different drivers in the same situation? If Tesla upgrade (and probably recall all their cars) would a similar accident happen again?

The real point is Tesla, Mercedes & Google will all have accidents and then fix them once and for all.
Humans make the same mistakes again & again even a series of different ones, we can't upgrade them.

The fact is he was stupid enough to believe the phrase autopilot when all it is, is a fancier cruise control with a posher name...

You are aware that is a known story and someone had disabled the auto brake option without realizing...

I rather like it on my new VW. I don't trust it but I'm far happier letting it try to protect me as an additional protection beyond just myself

It Was funnier than that. The hanger interfered with the radar system, so they decided to rig it by disabling the system and running the cars over a plank of wood so the drivers knew when to brake...

                It didn't work so well

Getting used to letting the car brake automatically takes balls of steel.
