IPSE insurance would cover some losses for things like this. i.e. cancelling contract before start and not paying notice.

I had one pulled on a friday pm before monday start. To be fair, IPSE paid me the one day notice period that the contract stated. Not much but better than a poke in the eye....

You've said this before and we asked for a citation and you said you 'think it might'. Fancy finding us some facts to go on?

Section 1.2 of the Business Interruption Claim form - "Failure by the agency to honour contractual arrangements" should cover it.

So you can use that to get your notice period paid if the decide to can you on the spot as well?

What if the contract has the no time sheets no pay clause. What losses has the contractor incurred to claim against or are they not bothered to that level of detail?

You have to ask Abbey Tax who provide the protection - if you contact the office, then they will be able to put you in touch directly with someone who is in a position to confirm that.

I hadnt started so no timesheets. I just supplied the contract, emails from agency and they paid up.

Perhaps if it had been a larger amount they would have been more fussy. Dunno.

Still at least it delayed the visit to the JobCentre to sign on, for a few weeks

Well I spoke to Abbey and it does indeed appear that as long as you have a proper signed contract with a specified date and the contract goes belly up before you start you can claim BUT it's only a max of £1000 and it's only if there isn't a clause in the contract about it being pulled before it starts. If the expectation on both parties is to start on the date signed it's claimable.

Same for it you were terminated without notice but there are caveats around the reasons. If you have a pretty generic clause about instant termination for unreasonable behavior it gets complicated as to what unreasonable behavior is. Is not being better than a permie an unreasonable reason to bin a contractor? I would have thought so but it's probably best to debate on a case by case basis.

Oddly enough they pay out more times for both jury service and agents going belly up than the situations above. I wonder if that is because only newbies tend to struggle with this part of contracting who are also most likely not to have IPSE+ in place.

                      Interesting.
