Not if you put the right wording on the timesheet they can't.

The agency can refuse to accept your timesheet.

Personally I get the contract written correctly from the beginning.

Turns out the CEO who had the power, doesn't.....and new CEO does. Job done.

New CEO wants to see me.....

Anyway, I'm off researching this opt in / opt out as that is clearly something I wasn't aware of and something I should be.

This opt out/in was a bit of a debate at first. BUT, rule number 1 here is decide for yourself and absolutely completely ignore anything the agent says.

They want to get you opted out purely because it makes thing less hassle for them. They dont care a hoot about you.
