Even if all these avenues were exhausted, Montpelier would still appeal at the Commissioners on the following point of law:
Section 58 FA 2008 has no application as it is my trustee who is the person legally entitled to the profits of the Isle of Man partnership not me. I am entitled to the profits of the trust by virtue of the terms governing the trust not the terms of the partnership.
Potentially, this could also go to the High Court, Court of Appeal, HoL.

There are quite alot of people who would be pleased to see me dead : I have a god given talent for really upseting people who cross me. However in the months (6?) I sat next to SantaClaus at clientco it was fun all the way! More and more of the SantaClaus types have left clientco to be replaced with muppets....

I just wanted to confirm I have/havent understood correctly how the process works on the HMRC site. If I want to purchase a CTD, it needs to be at least £500? Furthermore, I need to send a cheque and a covering letter, or can I just do a bank transfer?

If you do a bank transfer (CHAPS) then you still need to send a covering letter. For small amounts, it is probably easier to just send a cheque and avoid the bank charges.

interesting the government didnt bother to apply retrospective legislation in this case. Why did they think they could get away with it in our case, cos were little people maybe?

on reading, it looks like there was a measure of retrospection, hmrc were trying to claw back tax from before they changed the rules in 2005.

what dont they understand about cause and effect,

Petition on No 10 website

In order to help with future lobbying activities etc. I am wondering if it would help to have a specific allegation in the public domain. The most visible way I can think of doing this would be a petition on the No 10 website.

What do others think about this in principle? (not the specific wording)

Hold an inquiry into Section 58 Finance Act 2008

Details:
Parliament was given misleading and incomplete information when Section 58 was debated. Had they been presented with the true facts of the case, then it would have been clear that the use of retrospective legislation was merely an expedient for prior maladministration on the part of HMRC.

Given that Section 58 will inflict financial ruin on hundreds of ordinary working families, the Government at least owes it to these people to carry out a review. After all, if the Government has nothing to hide, then they should welcome an opportunity to defend the legislation.
