    This could run for years

Assuming we get the oral hearing within the next 2-3 months, and then get the green light, the JR should take place towards the end of the year. However, whether this is won or lost, there will almost certainly be further appeals.

According to the in-house legals at PwC, they reckon their ECHR case could take at least 3 years.

Even if all these avenues were exhausted, Montpelier would still appeal at the Commissioners on the following point of law:

Section 58 FA 2008 has no application as it is my trustee who is the person legally entitled to the profits of the Isle of Man partnership not me. I am entitled to the profits of the trust by virtue of the terms governing the trust not the terms of the partnership.
Potentially, this could also go to the High Court, Court of Appeal, HoL.

So I will probably be dead before this is sorted?

Can HMRC claim off my children?

This is what I'm hoping Brillo. Can we drag this case on for another 50 years?

I dont think my daughter will want to stay in bankrupt Britain either when she's older.

          Rampant Inflation

A bit off topic this but...

If the case does drag on for say another 5 years, and inflation comes back with avengence as many are predicting, then the debt may be irrelevent even if HMRC win.

Time could be in our favour. Of course, whether you would still want to carry on living in a bankrupt country or not is another matter.

It relates to failure to make the payment on account due at end January (hands up - my fault). However, I have not received any previous demands for payment (in my language "final demand" implies that there have been previous demands).

Ordinarily I wouldn't be that bothered about a little interest on a relatively small amount but the late receipt crossed 28 February from which date I am advised that a 5% surcharge will be added.

By coincidence I spoke with a colleague who also received a Final Demand notice last night dated 16 February 2009. Unfortunately for them the demand ignored the DTA and was for a figure assesses by HMRC!

Is posting of backdated letters systemmic in HMRC? Have you received a Final Demand notice lately? If so, when was it dated? When received?

            Thanks
I've not had final demands but I long noticed that every letter i get requiring action in a short amount of time is at least 2 weeks back dated - obviously posting letters is another thing that Hector hasn't managed to master yet. I know of no other institution or company that does this, my conclusion is that it is either deliberate or monumentally incompetant - take your pick.

What day does the letters arrive? Almost all of mine have arrived on a Friday. I think they only post once a week (or two!). One letter never arrived because the HMRC forgot to post it.
There's an elephant wondering around here...

now you mention it - it could always be a friday since I amost always go away at the weekend and I'm sure I get them as a nice "present" when I get back on Sunday nights - never noticed that before...they must have the least efficient post room ever created!

I think you credit them with too much intelligence.
I would go for the monumentallly incompetant option
