Are you suggesting that HMRC does not have access to everyone on the scheme?

Anyone with a bit of common sense at HMRC head office could just go through tax returns and get them.

Anyone spot the flaw in my argument?

In the early days, there was no disclosure regime for tax avoidance schemes, so the Revenue would have had to filter tax returns for DTA claims. Many of us have reason to believe that they were tipped off before any returns were submitted. In the first year they caught virtually everyone which strikes me as too much of a damn coincidence. In other words, it appears that they were ready and waiting.

Jones and Morris set up the ir35amnesty website in advance of any IR enquiries so it's not beyond the realms of possibility that they were colluding with the Revenue after they closed Suo Motu. Maybe this was part of the deal for getting a more favourable settlement for their clients. We know that HMRC have no scruples when it comes to soliciting information:

Jones & Morris even managed to get hold of a copy of one of the early enquiry letters:

The question is did this come from an MTM client or from the Revenue?

I know one person who has been in the scheme since beginning (one of first five in ) who has NEVER heard a single thing from HMRC.

Is filtering tax returns that difficult? I supppose it is for those with low intelligence.

My 5 year old nephew could design a better website than this one.
He could also write better content.

Maybe they've greased the right palms.

It makes it a lot easier though if you know what you are filtering for, and better still if you've got a list of names and addresses to cross reference.

Ironically, the fact that HMRC were fully aware of the scheme from the very start now counts heavily against them, and makes it much harder to justify the use of retrospection. They would have had much more of a leg to stand on if they'd only found out about it recently, as Jane Kennedy falsely claimed.

I was hoping HMRC would miss that one!

But even with your highlighting it will probably still escape them!

I have received a nice letter from Hector giving me the opportunity to re-submit my 2006/07 return and asking for final accounts for Trust and partnership upto April 2007.

I have passed this on to TQ/NW.

Noticed that the CTD page has gone missing
                      http://www.hmrc.gov.uk/howtopay/cert_tax_deposit.htm

I'm trying to contact someone regarding my current CTD - anyone got the telephone number I need to call? Can't find anything on teh HMRC website.

                      cheers
