I think we all know who you are talking about. They took advice following the introduction of the MSC legislation and were advised that the scheme wouldn't work under the draft MSC legislation from the start of the 2007/8 tax year. Rather than continue with the scheme they closed it down and gave the individuals concerned 4 weeks notice, even though the final legislation was only provided 3 weeks later when it would have been too late for anybody to do anything. I leave it to you to decide whether that was the right thing to do or not.

Do you have an enquiry relating to your time with that provider? If so have you contacted them because they are still actively supporting anybody they know has an enquiry, even though they haven't offered the arrangement for the past couple of years.

They'd have to be really silly to be surprised by that. Oh....
There's an elephant wondering around here...

To date one scheme is under investigation but they went bust when they realised that they could be responsible for the tax of the scheme members.

I know another contractor who is trying to cut a deal with HMRC, but from what I can see they are not interested.

Why did you not go with montp? Why not go limited now?

I had never heard of montp until Tim Warr told about them.

I have always had a limited company from 1995 to now, but got talked in to joining a iom scheme by my agent who was running it...

            MP response

My MP, Richard Ottaway, has responded to my letter on Section 58, stating he has written to the Govt on the matter and will advise the outcome.

Standard response I guess, but hopefully with the level of concern being raised here, someone of importance will start to take note !

                Mr B

has been on the backburner of late but he's next on my list. Something along the following lines to start with.

                Dear Mr B

You, and your predecessor Mr L, have sent me a lot of letters over the past 5 years.

I have a very simple question for you.

Why did you wait until 2008 to mention the 1987 "Padmore" legislation?

                Yours sincerely,
                Mr DR

                      Response From MP

I have just had a response to 'the letter' from my MP who has attached a detailed letter from a response to another of his constituents.

It contains many quotes and extracts from parliamentary debates etc of which I am sure many have been posted here before.

Just wanted to know if anyone would like to see the attachment, more than happy to forward it on, or post it here (6 pages).

                      Resonse was ....

                      "Dear Mr. X,

                      Thank you for your message.

I have previously taken this matter up on behalf of another constituent and attached is a briefing note prepared for me by our Library which explains what has happened. You will see that my Party did divide the House of Commons’ Committee that debated this issue but that the Clause was approved without amendment by a majority in Parliament despite Conservative opposition.

I am sorry not to be of more assistance - but HMRC should have told you of your right of appeal under the tax collection procedure.

                      Yours sincerely,

                      Michael Mates"
