    If you are thinking of settling, bear in mind that if they discover their mistake at some point, they could still come after you for the other year, and by then it might be too late to appeal.

    I can see it may be tempting but it's not without risks.

        No, you are right. Each year's Closure Notice is treated as a separate appeal. If you receive 2, there is nothing in principle to stop you settling one and appealing against the other.

        However, I still reckon it's risky to assume that HMRC won't realise their mistake at some point, and you would feel pretty if you settled one CN, and then received the other one a few weeks later.

          Closure notices - some people are saying they have had them for some years and not for others.

          Montp have quite a few where say 02, 03, 06 and 07 were issued but they have queried figures for 04 and 05. Once montp answer those queries CN's are issued for the missing years but it could be up to 6 weeks later. Bear in mind this oculd also happen where someone was on scheme for only 2 years. One CN issued then the other one, weeks later.

          Where they have issued "discovery assessments" we have appealed using a specific format which counsel gave us, HMRC have not come back to montp. Montp *think* they will have to consult their counsel for a response but bear in mind that montp have been appealing against Discovery Assessments for a few years now and montp have NEVER EVER had HMRC respond in any shap or form to them.

          As usual - all HMRC communication should be forwarded to montp!!

            I was on the scheme for 5 years but have only had a CN for one year. Is there a time limit that HMRC have to stick to in issuing these, that if passed means they can no longer pursue? Im presuming not as cunningly it always seems to work in THEIR favour....

              I've received cn's for all the years including the discovered one, I am heartened by the fact MP are apealing differently to the discovered years.

              I was wondering if I would expect to get notification from anyone (either mp or hmrc) that the appeals have been lodged, hmrc seem to be just carrying on as if nothing had happened, revised SA's etc..etc.. (all ammo for the JR I guess).

              I'll sit tight.....

                I've had enquiries open on my 2001/2 tax return for 5 years, so if there is a time limit it's a bloody long one.

                  Even MTM have failed to answer 6 of my e-mails or return 2 left messages.

                  Maybe I dont exist! There is this kid who keeps bugging me everyday day though who says he see's dead people!
