    Retrospective Legislation.

    "Retrospective legislation" needs to be looked at in context.

      I believe there is a distinction between criminal and civil retrospective legislation. The former is a big "no no" but the latter, which includes tax law, is more of a grey area.

        Closure notice appeals

        I received closure notices on my montp returns on 23rd September. I forwarded them on to montp immediately. I was told my appeals had been faxed to HMRC.

        I never received any acknowledgement from HMRC with respect to my appeals.

        I just had a phone call from HMRC asking how I was planning on paying my tax bill.

        Has anybody received feedback from HMRC after sending appeals in?

          It's probably another tax office screw-up but I would contact MP immediately if I were you.

            For your interest, below are approximate numbers of returns under enquiry for the first 3 years of the scheme, as confirmed by MP.

            It's funny how HMRC only realised they had a problem last year.

              When I was sold the tax planning by Watkin Gittings he told me that they would be closing the scheme at 500 members so as not to make a HMRC full blown enquiry worth while.

              It also concerns me that they did not inform us when the copycat Suomoto scheme was forced into a settlement.

                Maybe it would have been better to limit the number of users but that's water under the bridge now. However, IMO they would have had to cap it much lower than 500 to avoid an enquiry.

                Suomoto was not forced into a settlement. The operators of the scheme surrendered it voluntarily, so it is completely irrelevant as far as we are concerned.

                PS. MP also couldn't prevent other promoters like DeGraaf using the "scheme". In fact, if MP had started turning people away, then more rival schemes would have sprung up to fill the gap.

                    Does anybody understand the significance of this (I don't...). Are 2 JRs better than one? Will they allow 2 if they are substantially similar?

                      Agreed, this is why/how Suo Motu managed to reach a settlement with HMRC.
                      It was the Suo Motu operators that forced their very own members into a settlement or risk being left fend for themselves.
