You have no later than 3 mths to apply for a judicial review from when grounds upon which the claim is based first arose (ie when 2008 finance act was passed...). If accepted the case is then scheduled in the uk high court...

I think BN66 became law in July? So we should know soon whether it has been applied for?

One of my friends jointly runs a hedge fund and his big glass desk has a pile of different schemes along with many investigations from HMRC that he has entered into....... although regardless of the amount he has done and has had results and investigations that are still pending, he still entered one in Feb of this year. His schemes date back 10 years and the most used provider is Montpelier. He is very confident in their ability to fight with HMRC as he believes they are in the business for the long term not just to get rich quick from a few schemes. His point of "although they are in the business to fight HMRC if their IP is challenged, they are not in the business of being in court most days as they need to get on" therefore he regards their IP to be very strong and less aggressive than most.

Interesting! This is probably the most useful information I have read on here in the last few days. Very reassuring to know that the big city boys are using Montpelier and its not just IT contractors and a handful of property developers. Hedge fund managers are a lot better at weighing up risks than us and they have confidence in MP. Thats a good start!

I think if MP get this wrong they will lose all their clients and close down. I am sure they won't be prepared to do this.

I'm certain Helen is not a troll or hmrc, if I recall he/she (I'm poppy but I'm a bloke) was one of the very first posters on this subject maybe the first (before DR's current thread)
