    The trigger for investigation is moving from inside to outside.
    The SDS is simply evidence.

      It's not difficult knowing where to start looking for the biggest populations is it? And agency monthly payment reporting gives the same information by another means, pretty much.

          Looking forward to rates plummeting in April when all those splitters who ran off and closed up their companies start flooding the market.

          Also looking forward to even more posts asking how to restart a company within 2 years and not paying any tax.

            Oh most people will just open a new Limited company and find their way here when HMRC present them with a large tax bill.

                The idea that either the contractor or his client must determine how tax is paid is so stupid.

                It means that either you choose Outside IR35 and don't sleep at night from stress, or choose Inside IR35 and get taxed to death.

                So the government needs to find a way to end this uncertainty. i.e. Every proposed outside IR35 contract should get reviewd and written approval from them before start, so that the contractor knows he's safe before taking that contract.

                  That sounds like a recipe for.... not small gov't.

                  That said, perhaps they will introduce strict deeming criteria and be done with it. No contracts longer than 6 months. No contracts fulfilling a role that permies fulfill simultaneously (including temps, interims etc.). Obviously, that would be bad in other ways, but it would be simpler, and there is plenty of precedence in other jurisdictions. The current system is fubared by the size of the incentives (not just on employer NI, but expenses) and our common law approach to policing it, so you either reduce the incentives (in either direction) or take a totally different approach, legislatively.

                      Allowing the contractor to make the determination will not make the previous SDS invalid. That SDS will still remain a fact and will be evidence for the prosecution.

                      Best advice if switching will be to move to another client. Most won't.
