    OT hours and torture by Agency

    Hello experts,

    I'm director of a Limited company and have a contract with an agency with Over time (OT) clause. But the online time-sheet entry interface does not allow me to enter OT hours so I raised a ticket with my agency Service desk 3 weeks ago. Until now, they never bothered to reply even once and my problem not resolved. I worked 45 OT hours until now which needs to be entered in time-sheets and then get paid. My end client approved those OT hours (in end client hours interface) but I still don't have an option to enter them in time-sheet interface (by agency). I called/e-mailed them everyday but no luck and they even closed my ticket without resolving.

    Now I'm tired of all these and tortured enough by my agency, Could anyone please advise me What are the options (incl. legal) do I have now to get those OT hours money? Can I request my accountant company to follow up/for any other action??

    Send them a mail saying you will be terminating your contract with immediate notice if they don't respond in 24 hours. That should grab their attention. Another not so harsh option would be to stick 26 hours in for every day. They should ring you fairly promptly to query it so take them task at that point.

    I've not worked with an agency that has a service desk though which sounds a bit odd. I normally just ring my contact.

    No need to go legal yet as its not like they have not refused to pay you yet. Just an incompatibility with their system.

    Saying that I am assuming you are on a monthly cycle. Is that not the case?

    I do find it a bit hard to believe that no one will pick up the phone to you though. Can't you find alternative numbers on their website or guess some extensions and ring them?

    If you've got your out in/out status right you should be able to invoice them without a time sheet though can't you? If nothing else it should grab their attention as I mentioned above.

      Send them an invoice for the overtime hours and attach a copy of the client authorised timesheet.

        It's not a problem, just invoice on paper with a copy of the timesheet, don't use the online system it doesn't work.

        Legally they have to pay your "paper invoice".

          Your other option is that if their timesheet system shows weekends, then put the hours as Saturdays and Sundays - 16 hours per week extra.

            You're dealing with the wrong people. The ticket you've raised is with the IT department of the agency. They don't care. Your agent cares. If you've 45 OT hours to claim, then he's got 45 hours of commission to bill for!

            Two pieces of advice for your career

            1. Learn to figure out the key people you need to talk to
            2. Don't feel you have to conform to someone else's systems. Especially when they don't work!

                  I think you are being a bit over the top there. They might be push the boundaries but I very much doubt any agency would be as blatant as this.
