HMRC have written saying they will respond by 3rd August.

    2006/7 & 2007/8

As you say, these are getting knocked back straight away.
Was that aug 3 specifically to you DR or a general 'we will decide at that time' sent in some other capacity? as a number of us have been told verbally the 4/5 and 5/6 ones are 'stood over' but have no hard proof except mulitple verbal confirmations.

It was sent in a letter to one person but it sounded like a general review of the representations.

I have 3 years of investigations from my MTM days and got all three CN's. MTM said one of my CN's was issued late after some deadline where I never got an investigation letter and just the CN and they were going to appeal and do a test case etc etc and I heard no more. So the other night I sent the 3 CN's to CCW and now it has just struck me that my APN's came in one letter, but only for two of the years (head still fried). These are due to be paid end of June and I am trying to get the money together and still waiting on MTM to send me my letters to send off and more importantly for me, say if HMRC numbers are correct. ....Now....I am sitting here wondering what do I do about the other year??? Say nothing? Do nothing? Write to them and ask for copies of my APNs (in case the other one got lost in the post and I get fined)? Call them and say what exactly did you issue me APN wise please?... as the dog ate them!!!

I would suggest, fair or otherwise, it’s because HMRC ultimately want to get their hands on the cash and don’t care about collateral damage!!

They want the cash so they follow the money trail. There’s no point targeting a company which has little/no value and/or may not even exist any longer. Let’s not forget that the corporate structure affords a lot of protection to the individuals in charge (not that they did anything wrong but it does mean applying any kind of personal liability or penalty is almost impossible) not to mention that the company itself has nothing to hide as it operated within the law at all times and with full disclosure…..

Like you say, we’re a softer target but HMRC also know that any successful legal action against a well-structured corporate entity is likely to be fruitless, as such one must question their motives…

Everyone I know received all APN’s in a single communication, if it wasn’t in the same envelope I’d say it’s safe to assume one hasn’t been issued and it’s better left well alone!! Any mistake on HMRC’s part may ultimately play into your hands with the passage of time so don’t screw yourself over by pointing out their mistake whilst it still has time to come back and bite you in the ass…

Others may think differently or have received APN’s separately so it’s definitely worth getting some feedback before you act.

                    HMRC on-line

If anyone is unsure of which tax years to include in TAA, it's worth registering with HMRC on-line. This will show you which years have underpaid tax suspended under appeal.

Just to say thanks to everyone at NTRT who have got us this far.

I have just gathered all the required docs and stuffed them in a brown envelope ready to go recorded delivery on Monday. I have also paid up my £900.

Wishing us all the best of luck .. may justice at last be served.
