I have a letter headed Section 9A TMA 1970 saying enquiries intend to be made into 2 of my relevant tax years. Another letter similarly headed (Section 9A TMA 1970) says as Ive also submitted a return for a subsequent year, this will be included in their investigation.

Are these proper Closure notices as well?

      EDIT: Bah! Found them now!!
I've a similar headed note but nothing that explicitly says "Closure Notice". I've checked all the letters - is there anything I'm missing ?? I guess I'm being thick (again).
MTM wrote stating they thought I'd received an APN but nadda so far. No HMRC online access to check (waiting for activation code).
This is doing my swede in.

If anyone can tell me some wording of refs I'm looking for I'd be grateful. I'd be gutted to miss the TAA.

Have you got any documentation from HMRC which details what your liability to tax & nic is for each year you were in the scheme?

Do you remember ever receiving letters in 2008/9/10 which gave you 30 days to pay up or appeal? These would have been closure notices, which you would have passed on to Montp to appeal on your behalf. They typically look like this:

            An interesting shift

BBC uncovers 'aggressive' tax avoidance scheme - BBC News

Article on tax avoidance today is the first I have seen that talks about the company offering the tax avoidance scheme as the avoider; rather than the tax payer.

I believe HMRC have been chasing the wrong people all these years and aggressive Tax Avoidance could have been effectivley erradicated by increasing the penalties and shifting the tax liability to scheme promoters. Afterall, if I pay for professional advise thats turns out to be wrong, why am I deemed liable and they get off scott free?

So in context to TAA. If HMRC concede that they have got it wrong, they could save face by pursuing Montpellier for the outstanding tax - of course they may not be successful; but it would set the precedent and send a clear message to scheme promoters.

agree with you, clearly HMRC should have been recommending the government should refine the tax system via finance bills and then pursue the promoters. I am sure the reason they chased the individuals is because usual its easier than trying to chase the well organised, well funded promoter. I guess HMRC didn't foresee those individuals coming together in the form of NTRT.

                  APN for 05/06/07/08

Can anyone confirm that their APN for (05/06/07/08) or any years for scheme with MP have been cancelled by HMRC successfully ? .

Trying to judge to plan for raising the capital !! Rather than last minute bankruptcy.

I have lot of exposure to worry as any of the FTT results are months if not years away.

                  Thanks

there is no evidence that the cancelling has any ryhme or reason so it would be a foolish move to count on that in any way.

that said - it would appear - represnsatations against 05 06 seem to buy time . agisnt 07/08 seem to get knocked back immedaitely

                      2004/5 & 2005/6

HMRC have written saying they will respond by 3rd August.

                      2006/7 & 2007/8

As you say, these are getting knocked back straight away.
