    What happening with Peak? Are you referring to the peak association situation being incredibly complex? Can you elaborate at all?

    Has anyone else received letters from FS Capital? I have received two this morning stating they previously wrote to me and offered a 6% settlement but now they will take 8% and it will continue to go up (pressure tactics). I have responded/disputed using a boiler plate (ETC tax) with some additional amendments.

    They (FS) mention in the letter that they are being taken court by a Peak Performance sponsored group (GA) - is anyone involved in this (or any other legal action against FS) please DM if you are?

    FS will never receive a single penny from me.

    I know 4 other people who have received these letters/demands from FS Capital (relating to Pinotage/K2/\hyrax) and not one of them has replied in any form (same goes for me). Stay strong, delete it or put it in the bin and enjoy your gin (last night of course not for breakfast....)

    I wonder if this is their attempt to get you to pay something which they are hoping will legitimise the non existent total debt?

    I received a threatening email from FS Capital. In short they want £950 so that they dont assign the debt to anyone else before May 2021 and so that they dont take enforcement action before then (they will take the £950 off the final settlement - LOL).

    Once FS Capital produce and publish the full, unabridged and correct paperwork* I will potentially take it more seriously (though, as I've stated many times, I will never ever pay them a single penny under any circumstance).

    I do not believe FS capital (with their '2 bit' law firm) have the resources or the will to pursue what are multiple 'bad debts' and furthermore I do not believe they can win in any court under contract law - I have a copy of my 'agreement' and it looks like it was written by a five year old - when I compare it to Bank/Building Society loan agreements it's laughable.

    In my latest letter to HMRC trying to reach a settlement I have noted that I am unable to settle whilst I am being engaged by FS Capital.

    * Initially I would like to see the actual contractual assignment/novation's and crucially the reasons why this assignment was in the best interest of the employees (the fact the trust must always act in the best interest of the employees was a key selling point of both K2 & Hyrax).
