    The quandry is, a neighbouring property on a housing estate which backs on to the unadopted lane, has decided to take down their rear fence, build a wall and looks as if they intend to use the rear as an entrance to their property, rather than the front. They have never been down or used the lane before.

    My concern is about the extra traffic down the lane - it is nice and quiet with little traffic, and is single track, so if one car meets with another, you have to back up 1/8 mile to let the car pass, which is annoying. Fortunately, this happens very seldom, but may happen more often if theis comes to fruition.

    My second concern is that between the 4 propeties on the lane, we maintain it and repair as necessary, which I'm quite sure they would have no intention of contributing to.


    Anyone - Where do I stand in terms of legality, allowing them access down the lane, rights of way etc. I know I should and will talk to a solicitor in good time but any similar experiences on here?

    I had a similar issue. I had always enjoyed unfettered access to next door's passageway. But when I had my frontage redone I couldn't access it anymore. I've had a temporary extension constructed and the old man is happy for me to use his alley, but it's very well used and dirty, so it's not ideal.

    I had hassle with my neighbour because he got arsey because I drove over 3" of his garden getting onto my driveway. His garden was a mess as well so not like I was ruining his lawn.

    Seriously, if the ownership of you and others over parts of it are recorded, this is a private road, not an unadopted public road and I can't see why another should have any rights to use it uness there is established prior use. I think garden law or neighbours from hell are better places to ask this question but my own view would be be - don't waste your time or money with legal advice or actions. By all means discuss the possibility of letting him use it in return for a contribution that covers costs if you want to but, if you are not satisfied and don't get an agreement in writing, just get together with your neighbours and block his entrance off. Let him take any action - chances are he won't. It is always much better to defend than to initiate.

    Reminds me of the squatter who got the right to own a flat in Lambeth because the council were to useless to evict him in time. As the flat was on the top floor he could only legally access it by using a ladder.

    I would suggest you and a couple of the neighbours get together, dress up in black and put plastic childrens masks over the top of your balaclavas then burst into his house at three in morning, beat him with socks full of sand, tie him to a chair, douse him in petrol, tell him you're going to set fire to him before cutting of his right ear & threatening to come back and finish the job if he finishes that wall.

    Just wondering if the shat hits the fan, and I have a few Stellas one afternoon and then decide to concrete some posts in front of the entrance he's trying to make, I wonder if he tries to remove them, I could charge him a £500.00 bill to replace them.... Criminal damage and all that. I'll have to check with the LR exactly where my bit of the road starts and finishes before doing it though.

    Spoke to the council this morning and they made it pretty clear that they are not the slighest bit interested in anything other than if the wall exceeds the 2m limit. They said it becomes a civil case and to speak to my solicitor. Who mentioned again how the council can be quite useful?!
