If your contract is directly with the recruitment agency and it states that they will pay you regardless of whether or not they have been paid then they have breached that contract and you have a legal right to recover the money - see NotAllThere's post. If you have opted in to the Conduct of Employment Businesses regulations then the agency has a legal obligation to pay you regardless of whether or not they have had funds from the end client - if they are not meeting their obligations then you can report them. If neither the client or the agency is prepared to pay you then I would seriously consider whether or not this can possibly work for you in the long termOriginally posted by Alig View PostHi I hope somebody can help me. I've just started work as a contractor and have signed with a recruitment agency. I've been working for them for over 2 months and they still haven't paid me. They have said they can't pay me until they have been payed themselves. I've read in their contract that they will pay me regardless of wether they have been paid by the client. They won't return my calls. I have sent them emails informing them they have breached their contract. I have spoken to the company I have done the work for to see if they can pay me instead but they're just as bad. The thing is I love the job and the company is great it's just the recruitment agency. Can anybody advise as I'm owed over 2k.

OP should clarify if they are employed by the agency under PAYE or operating through either an umbrella or their own company.
