I've got a really unhappy IT contractor friend who has not been paid

So he's too busy working on a rate that only gets him £5k over 3 months to chase a claim that takes a couple of hours and worth £5k to him. I think he's got his priorities wrong IMO.

The company the website represents is registered here, but from earlier digging I suspect the parent co. is Indian and so relevent as to who the contract for services was with.

Then the guy is probably just going to have to whistle for his money.

If they are based in India, there are no steps. British law has no jurisdiction over there.

First step is to check his contract and see what it says about payments. If the client or agent are not paying up on receipt of invoices and / or timesheets then options depend on what jusridiction it falls under and whether the actual end client is a UK ltd co or not. If they and your friend is also UK based they need to go have a read of this:

Lots of info their on late payments legislation in the UK and how you caqn use it to chase overdue payments and get interest and other costs added to the outstanding amount before going down the Small Claims route.

If either the CLient or the friend are outside the UK, then they are probably out of luck.

So do what the original poster of the thread did: read the link above that vetran posted, do what it suggests and tell the agency about his rights and the fact that he will get a debt collection agency involved.

They may just give him his money.

Back to original problem - is it easier to simply file a small claims court thingy? That was my real question? Surely you guys get this problem quite often? What are the first steps for this please?

Looks like they are an Indian owned firm which may explain the relatively low money for the job (by UK standards) and the issues with payment. Any redress for the OP's "Friend" may be limited depending on where the work was done and who for...

Minor point of interest, the "live" version of the site pulls in an image from the "Dev" domain on the server and the Dev site itself is fully visible and actually loads and runs better than the current live one.

The Google cached vesion is older still and contains different meta data text including the Indian references.

No idea f this helps the OP or not, but it passed a few minutes for me.

My friend has done the website/CMS for Tradenext Ltd but they have not paid his last three months' invoices totalling about £5,000.

The work he has done is live w ww.tradenextglobal.com and the work has not been contested.

He worked there for about a year, and worked a full month after giving his notice, even though he was owed over a month of holiday time.

What should he do to get the money from them?

I want to help him - he has five young children!

and take the accusations off websites as that is not going to help his case. Especially when the Lawyers get involved.
