Plenty of examples been posted on here recently. Bearing in mind this kicks in in less than 2 weeks you'd expect every gig to have some statement either way on it now.'CUK forum personality of 2011 - Winner - Yes really!!!!

It still shows a mixed approach as I believe this role to be in Manchester, and whilst they've decided to place the role inside IR35 there are almost identical roles I've seen in Leeds at other PS bodies that have placed the roles outside IR35.Originally posted by northernladuk View PostPlenty of examples been posted on here recently. Thats because its for each PSB to decide whether roles are inside or outside. Some have a more open attitude to assessing this. The risk averse ones are going inside. It's also down to local working practices. Some PSB's are more flexible than others when it comes to SDC.Originally posted by Murder1 View PostIt still shows a mixed approach as I believe this role to be in Manchester, and whilst they've decided to place the role inside IR35 there are almost identical roles I've seen in Leeds at other PS bodies that have placed the roles outside IR35."Being nice costs nothing and sometimes gets you extra bacon" - Pondlife.Comment

This.. And there is the possibility some PSB are getting it wrong and there are going to be U-Turns in the coming months which could be a problem.Originally posted by DaveB View PostThats because its for each PSB to decide whether roles are inside or outside. It'll be interesting to see how all this plays out over the next 12-18 months and whether any do reverse their decision (either way round).Originally posted by DaveB View PostThats because its for each PSB to decide whether roles are inside or outside. I think that this is the biggest issue. When HMRC see the number of outside decisions, they'll start leaning heavily on PSBs.Originally posted by northernladuk View PostThis.. What happens if the PSB subsequently changes their mind on the initial decision? Will they even be allowed to change their minds?
I'm not sure if anyone knows..."I can put any old tat in my sig, put quotes around it and attribute to someone of whom I've heard, to make it sound true."

And you can get your bottom dollar if HMRC get's a PSB to reverse the decision 9 months in they certainly won't respect the initial decision for the 9 months as they have said they will. That then means the contractor could be in the cross hairs of a retro grab they thought they had avoided with another 9 months on top.Originally posted by cojak View PostI think that this is the biggest issue. Interesting...
I have been direct with an NHS Org for past 12 months and we have been discussing my renewal, originally everything was fine and I would be renewed outside, got a phone call yesterday to tell me HR have made a blanket decision and all contractors inside - no budging by the looks of it.Comment
