Take on role left by permie BA but outside IR35?

As far HMRC in concerned is it possible to take on role left by permie BA if they left becuse of illness, but still be outside IR35?

As far as HMRC are concerned, all contractors are tax avoiders and should be inside IR35.

But, what you're suggesting here is about as strong an indicator as there could be that you'd be inside. What does the client say, as it'll be their decision from April onwards.If they say Inside, it doesn't really matter what anyone here thinks HMRC will say.

This. Absolutely inside. How could it not be? But it's their problem after April. You're just liable for the months before that.
