Day to day maintenance or project based network enhancement work?

If its the former and there are any permanent staff doing that work everyone doing it needs to be out the door (just long enough for the effects to be obvious)...

That only applies to employees NI and PAYE.

Employers NI needs to be paid by the agency.
First they ignore you, then they laugh at you, then they fight you, then you win. But Gandhi never had to deal with HMRC

Indeed but I bet they'll make sure their margin isn't affected. We get paid a cut of their money so they'll make sure they are OK.

Its a bit of both but mainly there for the complete network upgrade which once improved would hand over to bau staff. They are a third of the way through the project. If they all walked it would be a disaster, some very specific skillets in there. I know because I helped try to find more staff and we went through the few that may be good enough for interview and many of these were chancers who didn't really know the subject and none of the permie staff had the skills.

As someone pointed elsewhere it may depend on what your contract states - someone had a clause that said the agency could deduct tax if directed to do so...

              It really depends.

The 'payer' becomes liable for employers NI.

One imagines that the agency would seek to recoup that either from the rate they are paying the contractor, or by renegotiation with the client. Bear in mind the notice periods that have been discussed also apply to changes made by the agency - i.e. if the agent wants to reduce the contractor's rate, they are (in many cases) going to need to serve notice on the contract in the next couple of weeks to avoid April payments. If they are as clueless as has been suggested, many won't have even thought about it. As eek has said, many contracts will have something in to say that the agency can deduct any taxes incurred as a cost of the engagement.
