    The New Certainty is Uncertainty

    The retro wall is well and truly breached - HMRC will now be exploring where the new limits might be if indeed there are any. The potential for additional revenues is huge

      The article doesn't really say if getting a new contract, with a DIFFERENT PS client for a DIFFERENT role, inside IR35 or FTC, from 6th April draws a line under your pre-6th April work outside IR35 with other clients stretching back a few years.

      I had assumed it at least turned the RAG rating of retro threat from red to green, and am about to leave current outside IR35 role on that basis

          HMRC doesn't draw lines.

          They make their own rules up.

            Drawing a line is the wrong phrase - I think you can see what I am saying, and accept there are no definite answers. However I am thinking that moving to a different ps client from 6th April, doing different work with a different contract, probably inside IR35 as most jobs will be advertised like this with the nature of the tool and NHS management, will mitigate the risk (not eliminate the risk) of retro. If not there are literally thousands of people who have no options but to never work for ps again even if as an employee?

              HMRC will let us know some considerbale time from now and will backdate that decision and the particulars based on their revenue target. If a lot of people take mitigating action backdated provisions to catch that will apply
              That is the reality of the tax retroverse.
              The starting point is a pot of x million (A) in order to get to (A) all other variables are adjusted.

                I heard that one NHS trust has hired KPMG in to do the determinations and run the payroll, bang goes the government savings then.

                I'd laugh if it wasn't so tragic.

                    Kpmg do well -look at what Kpmg saved us.
