    I'm out of PS and staying well out of it.

    It's annoying though, get calls virtually every hour about two PS roles. Given they've had problems getting people in since August at least, suspect they'll be soliciting Bob consultancies soon enough to try to get anyone interested.

    Pity really as one is a mere five minute walk away. Drop son off for breakfast club at school, saunter in way before permies. About the only thing it would have going for it...

      But that doesn't stop HMRC trowelling through as much other stuffs as they can find while running up bills for my accountant. And possibly a legal team.

      HMRC are not known for being professional or reasonably well behaved.

        My point was that if your working practices are outside IR35 now, then whatever the client says in April doesn't change that. Agreed you probably don't want to put yourself in a situation where you're going to have to defend yourself, but if you have tax investigation cover then, if you are genuinely outside, you should win any retrospective investigation. If you have TLC35 or equivalent, then financially you have nothing to lose. Stress-wise it's another matter.

          Hi all,

          I'm in the public sector and have unfortunately made a career for myself in it...

          A few questions, if I may...

          If caught within ir35, in my existing contract... what repayment plans do HMRC offer, if any... or is it simple bankruptcy?

          If I continued with the same client, but change my job title/contract, would that help protect me against past claims/old contracts (HMRC retrofitting ir35 status).

          Finally, if I move within the public sector and get deemed inside ir35 with a new client, would that put my old contract at more risk vs moving to the private sector...

          I understand were all in limbo at present but I thought it would be good to discuss...

          My contract ends at the end of March, so I am very much on the fence at present.

            You'd think as you are in such a precarious position you might know the basics about this.

              Your best bet is to move to the private sector.

              But if you can't do that, of the options you present, the 'best' is to move to a completely different contract with a new client. But you will need to do this before the end of March - the new legislation applies to any payment made from April, so you really need to get out by end of Feb.

              If you don't already have it, take out tax investigation insurance to give you the best chance if you do get investigated.

                      I'm unsure of that advice. The question is could the tax investigation insurance cope with a surge of new cases? If (as some people fear) contracts deemed inside in April are all investigated I suspect that will be a lot of cases...

                      Hence I'm not sure an insurance scheme costing 1-3% of the possible tax due is going to cope with the potential demand for their services / money...
