              Oh I'm sure people realise that mistakes and bad judgement have been made. Most people will end up paying something to HMRC. It's just the vultures that irritate me.

                As far as I can see malvolio does nothing other than inject a healthy dose of realism - he's not trolling - just delivering a healthy slap across the face every now and again. Some of us need it.

                The doom and warnings are real. Personally I don't think that HMRC will stop until they've forced every contractor onto PAYE and we'll spend all our time filling in HR appraisal forms instead of delivering benefit to our customers.

                There are some arse073s on this site - I can be one at times, but nothing I've read puts this guy in that camp.

                Perhaps the 'HMRC Secheme Enquiries' needs a thread entitled 'Tummy rubbing' where we can all go and pretend it's ok.

                    I have a limited company. I pay myself dividends to avoid NICs and I gain an advantage by using the Ltd route.As far as I'm concerned I am a legitimate businessman. As far as HMRC are concerned they would like to see me as a tax avoider.

                    So, is the Ltd route 1000% nuclear bomb proof? Do HMRC have Contractors in their sights? Are they mendacious bast&&&s?
                    Do I feel safer in a tax environment where, arguably, retrospection is deemed acceptable? When/IF they roll over the EBTs where will they go next?

                    I've given up trusting anything, when I start to feel a bit safe, I need miserable malvolio to remind me that it really is sh1t. Only he knows if he's a troll or just a realist, personally I reserve my ire for HMRC.

                    On the upside, I've told my accountant to tell HMRC to f*** off.

                      Hmmm...

                      I do feel at times that some are painting us all with the same brush and that somehow we have brought the whole freelance profession down...

                      I have no doubt there are some had a priority of avoidance of income tax when going on these schemes, and whatever the rules were at the time, they have acted within the rules.

                      But there are many who were sold a very slick sales pitch of avoiding IR35 and simplifying administration and no accounts (not LTD).

                      I think its slightly patronising when some are now stating that you should have known better etc etc...some of us haven't been freelancers for long, and many take advice of professionals such as Chartered Accountants. People need to understand that these marketed schemes were available to Chartered Accountants, who have access to numerous tax schemes to aid their clients. I for one took advice from a Chartered Accountant, I didn't seek to join a scheme.

                      If anything the professions such as Chartered Accountants/Tax Specialists & Lawyers have a lot to answer for, and they should be tackled by HMRC not the individual who took their advice.
