Hi, I'm a new member. I receieved a warning letter yesterday for tax years 07 and 08 from when I was with Norla. Can you please provide me with PM rights? Cheers.Comment

Originally posted by superdryI'm looking for some feedback around two APN's I've received recently. I was with Norla for 4 years but I've only been issued APN's for a relatively small amount covering the last two years.
I'm resigned to the fact that I must now pay the APN's and eventually may or may not settle for the two years in question. My concern is that by settling I may be opening myself up additional taxes on the previous years which will amount to a lot more as I wasn't in full time employment over the last 2 years with Norla.
Given the advise I've had already on-boarded from tax specialists/, my initial approach will be to pay the APN to buy some time and review my situation in a few months time. I'm aware of the the various groups out there and the charges that come with them, but given my current stance the cost out weight the benefits of joining one (**this may change in the near future though)
Any feedback would be appreciated, in particular around any previous contract settlements and the details around a settlement.
My personal opinion - others are available - is broadly as follows.
Pay the APN if you can, either when demanded or arrange time to pay. The potential for a JR "win" is low. The potential for a penalty for non payment is high.
By all means look at settlement but be warned that it is not comprehensive. There are gaps in the proposal such as NIC and IHT. Settling the income tax may not protect you from future demands.
Presently HMRC has no legislation and no decided case that gives them an easy win against many schemes. Until at least Murray Group and now possibly UBS/DB complete their journey through the Courts (perhaps 18 months time) it's hard to see that HMRC can make a solid case.
Some contractor scheme groups are about to run an alternative analysis. HMRC will resist that and we may not know the final answer for a long time - say 5 years.
I don't know if the Norla scheme has an action group nor what the cost might be. I suggest however that joining it would be a sensible use of funds.
(I would say also, look at BIG GROUP - yes I'm involved in it - which might offer some knowledge and information).
Sit and wait if your scheme is not in line for a hearing at FTT.
Get some personal advice on the situation re the first two years.

Whoever was given 10-11 assessments to work out was not given the same crib sheet as the rest at HMRC!!!
Its' WRONG you need to challenge it.
Having said that, I challenged my assessment for 10-11 and HMRC agreed it was an error and issued a replacement one for around 7% of the original value over a year ago.
HOWEVER....the APN I've now received is quoting the original figure....
bless 'em, they do try...Comment

Yes, exactly the same with me! Further, they didn't offset my personal allowance either for the year so please check this on yours too?
I took advice from a Tax Specialist/Lawyer this week and posed the question that is this miscalcuation a deliberate scare tactic as surely those working for the HMRC - i.e. the Government dept. that works out our tax - couldn't be that THICK?!
His answer? "Wanna bet?!"
