Edge EBT thread

Hi All,

Michelle called me today and in effect she has stated that Edge is no more in the UK and we are not going to get representation from them going forward. She said that either way Edge were only there to guide us and that HMRC would pursue the contractors and not edge and that its best we get representation. Her advice was to stay together as a group rather than challenge this individually. As stated on the previous posts, she said a brief initial response back to the HMRC for the 09/10 letter would be sufficient stating that we wish to appeal and for them to postpone the collection of tax. I will be sending my reply in the morning.

Why is it that we are being targeted and Edge not ? I know they are no more , but what is the difference between us and the Rangers case that is going on at the moment? in the Rangers case the club is being targeted and not the players , in this scenario we are the players , or do I have it all wrong?

As we are on our own, can we not look to recover our costs and fees from whomever Edge was at a personal level?

I got my letter yesterday, relating to 2009/10. Luckily I was only with them for 4 months, before I moved on, but HMRC knew to the very penny, exactly how much was in the EBT loans. I wonder where they got that information from ...

The structure of the EBT was incorrectly setup hence why HMRC are chasing Rangers FC for Corporation Tax. Edge may well have set their EBT up correctly. So HMRC will potentially argue you had no right to use a trust structure under disguised renumeration as your relationship was nothing but a sham. You are going to have to wait and see i'm afraid. I wouldn't read anything into other cases.

Are you really an ex-EDGE employee or just a gleeful rubber necker enjoying the fallout ?

The EDGE scheme was fully disclosed and the information would have been submitted to HMRC via P11Ds .. if you didn't even know that much then you shouldn't really have entrusted your accounts and employment with them. The EDGE scheme was validated at the time by their 'top legal counsel' (who has an NDA with EDGE) and their tax advisors KPMG.

Take some proper advice yourself, contact Michelle Booth (who is still returning calls) and sit tight. Do not let the HMRC scare tactics get to you .. and you can't have much to lose over 4 montsh anyway.
