    Another One

Another Edge / Norla User - had my demand for 2009/10 on Friday - have read through every single post on this thread, and:

    1) Can I have PM rights, etc. to enable me to stay up to date, contact individuals, etc.

    2) The start of the thread was quite comforting and re-assuring - the balance now seem to be heading back towards worry and consternation

    3) Spoke to Advantage Accounts on Friday (29/11/2013) - who gave me Michelle Booth's contact number. Rang Michelle who was out of the office but a colleague of hers took my details and said that she would ring me on Monday - let see.

    4) Worrying that the point of contact for organising the group action has not posted on here for several months

    5) Worrying that the whole group action thing has not been progressed

    6) Personally, I would be happy to contribute to being represented as a group rather than a individual

    7) Are there any other similar threads or forums on other 'sites' that anyone is aware of?

    8) Thinking out of the box - isn't the easiest solution to this problem, for the Edge Benefit Trust to ask for repayment of the loans. That would make the HRMC situation go away, and all that would be left is how much you pay and over what period - there must be an angle here?

    9) Don't suppose there is any 'good' legeal representation out there on a non-win / no fee basis?

    10) I am Manchester (Altrincham) based - so happy to bounce ideas, share concerns, drown sorrows - if anyone is in the area

    11) Does anyone have any experience of Tax Tribunals - are these like industrial tribunals where its more laymans speak and common sense arguments - or are they heavily litigious and entirely based on law doctrines

And thats it from me - still numb with the fear of having to "find" a significant amount of "spare money" - but hopefull that HMRC will allow common sense and justice to prevail.

      Yet another one.....

I was employed by Edge for 2.5 years from 2009. I received an enquiry from HMRC on 23rd November 2012 asking what sums I'd received in loans and expenses from Edge for tax year ended 2011. I contacted Michelle Booth at Edge who provided a letter with a full breakdown of the amounts and the terms of employment/loan. I then heard nothing until this week when I suddenly got a letter thanking me for my 2012 tax return stating my 2011 return was still being checked as it is believed there are inaccuracies and that my 2012 return was going to be checked for the same inaccuracies. I was only employed by Edge for 5 months in 2012.

I then suddenly got a letter yesterday relating to my 2010 tax return out of the blue with a tax demand for a significant sum stating the 2010 loan related to professional work in the UK and is taxable income under long standing tax avoidance rules.

I have read through this thread but am deeply concerned as I'm sure all on here are. I am going to try and contact Michelle Booth now of Redstone tomorrow - got her details from Advantage Accounts. Sounds like I need to send an appeal letter in the first instance and I've seen some examples on this thread.

Given some of you are further on in this process can anyone advise where things have got to or offer any advice/support.

There seems to be talk of a group fund for legal representation which I'd like to be part of.

Can I be granted PM access please.

      Thanks all

        also worked for edge

        Hi all,

I received last week a letter for 2009/10 and 2010/11.

Got a similar one in February for 2008/09. Back then Michelle gave me all the instructions to follow.
I emailed again Michelle except this time it bounced back. I then found this thread with many other Edge employees under the same situation.

I'd like to join the group "TheDandy" is trying to form

Could the admin please grant me rights for PMs?

        Thanks

One more and interested for common representation...

Hello, received my letter last week. Read all the posts and sending the appeal letter tomorrow. Talked to Michelle last week and she confirmed that no representation is to be expected from Edge which has ceased to trade anyway.
Confirmed the template to use with the shortest one - which was posted by MJ Perry
So group actions seems definitely the best option.
As others, I did not see 'TheDandy' manisfest himself for a while but Will be open to PMs for info on being represented as a group.

Admin: May I be granted PMs rights please?

          Cheers, All.

            Template Variation

Shown below was going to be my response to the 'dreaded letter' - any thoughts anyone?
Its basically the standard response but asking a few more questions - helps to know exactly what they know

            Case Ref:
            NI Number:
            Your Ref:

            Dear Miss Stopp,

I acknowledge receipt of your letter dated xx/xx/xx, a notice of assessment to Income Tax for the 2009-2010 tax year.

Please take this letter as my formal notice of appeal against this assessment and also a request for suspension of collection proceedings.

Furthermore, I would kindly request, under current freedom of information legislation:

            1) All information that you have with regard to this case
            2) All information that you have utilised in arriving at the additional taxable income figure of £XXXXX
            3) The dates and sources of all of the above information as well as any formulas and calculations used and any assumptions made.

Please could you acknowledge receipt of this letter.

            Yours sincerely,

              Appeal letter

I think you might be better off using the simple template.

That's not very helpful - why shouldn't anyone ask HMRC for information? Are they the only ones allowed to ask questions / change the law and apply it retrospectively/ produce demands based on random figures etc?.
Do we really just have to take whatever they throw at us and not even ask for some relevant and possibly useful information ourselves?
                Can you explain your comment?

                  Group representation

Hello all, whilst TheDandy is not posting here any more I believe he is still monitoring PM's about the group representation.

It's a big task he has taken on and obviously not his 'day job' so give him some time to reply.

Does anyone have 'the short response' which should be sent for the 2009/10-2010/11 years from Michelle?
I already sent the longer version in Feb for my 2008/9 year.

I'm thinking that I should send the same (long) response again, and perhaps make an addition of the shorter version if there's anything different in there.

Also, has any tax specialist glanced over our situation...it would be interesting to know their thoughts.
