    Coming and going from UK - while under appeal

    Hi,

    For any of those who have had appeals to suspend payment accepted (and are awaiting outcome), has anyone experienced any issue passing in and out of country while under appeal?

    Would not expect any issue, but wanted to see any thoughts.

              No worries Rob79 was looking at how to respond to the Garraway letter I received and not to ignore it as per CHS advice. Sanzar settlement I am waiting to see what everyone else is going to do or wait for an APN? I may be in a different boat as I was not asked to do a SA return queried that with Sanzar who said "If your not asked to do one - don't worry about it" little did I know back then.

                1. You are responsible for filing a return. If you had taxable income and did not file, you are laying yourself open to penalty. Lack of knowledge or reliance on others is not a reasonable excuse. The law puts the obligation upon you to notify HMRC, not HMRC to issue a return. Sanzar is completely incorrect on this issue.

                2. APN is on its way but may take anything up to 15 months to arrive. It seems that nothing has been issued so far on contractor schemes and this may be because HMRC does not want them challenged on the grounds of insufficient information to make a reasonable judgment. The delay will not last forever.

                3. Wait and see is a valid strategy so long as there is some action being undertaken which will possibly benefit or inform you. That may be the promoter preparing for litigation (on APN and/or scheme), an action group engaged in discussions with HMRC/lawyers or you are dealing directly with HMRC/lawyers etc. Wait and see when nothing is happening is not a good strategy.

                4. What other people do will have no effect in your position UNLESS there is an agreement with HMRC for group action. Even if the scheme has a lot of participants and they are all in the action group, you will get a range of strategies being followed. Unless you are aware of them all and able to select the one you want and get that sub group into discussions with HMRC/lawyers etc, you have no protection by being in a "herd".

                  It's a good job I was only with Sanzar for 5 months and yes small amount compared to others why have I not just settled? why should I?

                    I too have had an enquiry letter from hmrc yesterday regarding garraway limited, contacted CHS and received a standard "Ignore it" response.
                    Really don't feel that is the right response,am nervous now and keen to know how to respond or should we be doing a common response ?. Even obtain recommendation of a tax specialist who could respond on my behalf.

                      Have now upgraded your account. PM is just an acronym for the Private Messaging system on the forum that you need to get in contact with the others on the forum to help you. You now have access to the system so please read the other threads to see who you need to contact etc.
