HMRC enquiries for EBT schemes through SANZAR

Sanzar Partnership scheme (2007/8)
Was anyone here in the Sanzar scheme which preceded the EBT? It involved an Isle of Man partnership/trust, and was targeted by retrospective legislation (BN66/Section 58) in 2008.
We are trying to find out if the users have settled or whether they still have open appeals.
Please PM me if you have any info.

Hi horrada - you already have access to the PM system. Under the blue bar there is a list of links, "New Posts", "Private Messages" etc. Click Private Messages and you will then see the menus to send a new message etc.Comment

Purchasing CTDs / options
Just a passing thought on the CTD scenario.
If you purchase them, then the monies in the bank with the HMRC - means no more interest payable.
So, if you wait until the APN arrives.
1. How do they know what you owe? If it's calc'd at 5 X or 7X basic pay you received could be a mile out
2. Surely they cant be sure until you send bank statements
3. You could be liable for NI
4. Could there be further penalties?
If you settle
1. You avoid potential NI
2. It's "gone", yes like the majority of your bank funds
3. You avoid further penalties
4. You have payment "options" i.e if you cant afford, £1k p/m for example maybe?
As the letter states (if we don’t hear from by Jan etc, we'll assume you don’t want to take the settlement and it may go to tribunal) I assume this means potential further penalties.
I guess we're all waiting to see if "sanzar wins", which begs the question what’s the chances of that if no one's fighting the HMRC on our behalf’s, or are most tactics aimed at delaying payments seen an inevitable for as long as possible?
Sorry but does anyone think that the Sanzar situation has a chance of getting waived through / no fees / no settlement / no tax owing?

If well defended EBTs do start winning at tribunals then HMRC may come under pressure to review the situation. The pride themselves on an 80% success rate and that is achieved by only pursuing cases they think they can win.
If you settle you pay interest and get some peace of mind. If you don't you get an APN for the amount (excluding interest) if you then lose at an FTT there will be potential fines and NI (the advice I have suggests that HMRC would struggle with this).
The more people that settle the less pressure there is on HMRC - their nightmare scenario (as admitted by HMRC to my accountant) is having to issue FN/APNs and then pursue them.
