    Hi Masterarcher,

I would first of all go to the firsdt posting and read all that has been said.
Don't believe that there is a straightforward way of tackling this! - Talks of the Admiistrator administering the undistrubuted funds, but now beklieve nothing that I hear!
There are some email addresses scattered througout the postings and I would advise sending off emails to these people. Now some people are going to say that will jusdt clog up the procedures, but if you don't who is gioing to fight your corner!
After talking to my new accountatnt today, I am going have to pay circa £20K and hope that I can get some back shortly !!

    Hope this helps!!

      Any help and advise welcome.
      Hi Master Archer,

As per the above post in reponse ... also there are a couple of action groups so it is probably worth trying to get involved there as well.
We are all in the same boat of not knowing where we are going - so welcome aboard !!

They have left me with a large tax bill which they are supposed to have paid with the money they have retained. In the unlikely event anyone answers the phone, no one will comment on the money they owe either. HMRC know nothing about this apart from the fact that they don't like Sunday Solutions.

Needless to say, I will be chasing them relentlessly.
That's you and me both pal....

I have posted on this thread before but I thought I would put this on here in case it helps those taking part in legal action.

I may well have been one of the very last people to get my money out of Sunday Solutions. I resigned from the Whalley Prime Broken partnership in November 2008 and insisted on immediate repayment of all money retained for tax. I got the lot back. At that time there was no question of further fees being offset against the tax money so it may be useful to give this inevidence at any hearing. I believe the money came via WilloowMeade.

I guess this makes me one of those 'partnersip debtors' which is of course utter nonsense as I paid my fees as per the original agreement with Sunday and was fully entitled to all the money I recieved from them on termination.

I wish everyone the best of luck in chasing up their money.

I received my tax retention back in March 2009 and there was no mention of increased costs.

                  Satr

Out of curiosity, since none of you got the retention money back during the year 08/09, can you not file that amount on your SATR as an expense to reduce your tax liability? If a miracle happens and you do then receive the money, you can just file that as income for the 09/10 year surely?
You should not be paying tax for income you did not receive.

Please read this - response from +Intelligence Unit

                    Dear..........

Thank you for contacting the Serious Fraud Office (SFO) and for informing us that you suspect you have been the victim of fraud.

After consideration of the information you have provided to us, we have concluded that this is not a matter which is appropriate for investigation by the SFO. Accordingly, no further action will be taken by us and I hope the following will help explain why this is so.

The SFO is a relatively small, highly specialised government department that is permitted by law to investigate only those cases where there are reasonable grounds to suspect serious or complex fraud. For this reason, we take on only a small number of new cases each year and almost all of these are referred to us by the police or other law enforcement agencies.

That is not to say that the matter you have reported is any less important or any less distressing for you as a victim. It is essential that suspected offences are investigated expeditiously and our intention in informing you that this is not a matter for the SFO is to reduce the delay in it being brought to the attention of the appropriate organisation.

If you believe you are the victim of anything other than the most serious or complex fraud, you should normally pursue the matter through your local police force. The police have primary responsibility within the UK for investigating all types of criminality including fraud and other offences of dishonesty.

Contact details for your local constabulary can be found in your telephone directory or online at http://www.police.uk/forces.htm

Alternatively, you may wish to pursue the matter through one of the following organisations who have responsibility for handling specific types of complaints:

Department for Business, Innovation and Skills (BIS)
One of the stated organisational objectives of BIS is ensuring markets work to the benefit of business, investors, employees and consumers. It also works to deter fraud by enforcing the relevant law. This includes dealing with misconduct or unscrupulous practices, whether or not this amounts to fraud. The Companies Investigation Branch (CIB) of BIS is responsible for investigating companies under the relevant company legislation. Where CIB uncovers evidence of criminal conduct the facts are generally referred to the police for investigation or to its own prosecution lawyers.

You can contact CIB on or report a matter online at: http://www.insolvency.gov.uk/complaintformcib.htm

You may also wish to consider seeking independent legal advice from a firm of solicitors. They will be able to advise you of the best course of action and whether there are any remedies available to you. Free, confidential and independent legal advice for residents of England and Wales is available from Community Legal Advice, who can be contacted on 0845 345 4345.

In certain situations the information you have provided may be retained on our intelligence database for future reference. Information which includes any personal data (such as your contact details) will only be processed, retained or disclosed in accordance with the principles laid down in the Data Protection Act 1998. Please be assured that all information you have provided will be handled professionally and with the utmost sensitivity.

Once again, thank you for contacting the SFO and for bringing your concerns to our attention.

                    Yours sincerely,
                    ..............

I got the same. Needless to say I replied saying that all other law enforcement agencies seem to be rubbing their hands of it, that it was countrywide so local forces wouldn't be able to deal with it. That it was in fact complex, and if they are still not going to look at it then to pass it to who they consider the relevant body.
