    Success with MP - contact your MP

    At least one person has had success with their MP. Contact (preferably go and meet in person) your MP and explain the situation. Tell them that other MPs are aware and that they need to coordinate on behalf of their constituents.

    Don't give up on the SFO route - ask your MPs to contact SFO and/or HMRC on your behalf.

      Reducing Tax liability

      Out of curiosity, since none of you got the retention money back during the year 08/09, can you not file that amount on your SATR as an expense to reduce your tax liability? If a miracle happens and you do then receive the money, you can just file that as income for the 09/10 year surely?
      You should not be paying tax for income you did not receive.

        Thanks for your email. Unfortunately we can only deal with the company ‘Sunday Wealth Management Limited’. Therefore if you do have any documentary evidence that your money went to this company, we cannot get involved. Additonally there seems to be another company that used the title ‘Sunday Wealth Management’ and we are not interested in this either, just Sunday Wealth Management Ltd.



        If you do have some evidence of this then please forward it to me.

        One other thing I have noticied when Bradbury & Co send the account statements, it says one liners for each of the expenses (Legal, Accounting, Admin/IP fee, invoicing...etc), however did they ever show any paperwork for these expenses. i.e to who did they pay the Admin & IP fees.

        Have any of you seen any invoices/receipts proof for the following
        that was deducted from the partnership acounts,

        1. Insurance
        2. Accounting(bradbury)
        3. Admin & IP
        4. Invoicing & payments
        5. Legal support

        here who payed whom and who authorised these payments...who was managing these accounts...

          Yes, I got the same message - as mentioned before it appears that law enforcement are not interested !!
          As for the expense query, I certainly haven't seen anything on these lines.

          FYI I also e-mailed directly to Andrew McIntyre @ Bradbury as he is the named administrator on most if not all of the partnership accounts and just got an auto reply saying to go to the Info address.

          Have also written to my MP, but yet to get a reply ... will keep people updated.

              Undistributed profits

              Are we ever going to recieve these undistributed profits? I havent heard anything yet.
              My partnership was with Wunderlich Leonard. Has anyone had problems with them? I googled this name and it does not come up with anything!

                I wouldn't count on it !!! If we ever do receive anything it is likely to be a percentage of what we should have received because part if not all of the money has gone AWOL. I think we all need to plan for not receiving anything and if we do it is a bonus.
                Not easy I know, I am one who is having to borrow to cover my tax commitments ...

                  Hi there, I, sadly am one of the many who are yet to see their retained earnings. I apologise if this is an obvious question but what are the next steps. Do we have a timeframe in which we can act? And or is it official that the retained earnings will not get to us, and can we take legal action against a company that has gone bust or vanished?

                    I don't think anyone has been contacted by the administrators yet, so the retained earnings are up in the air. If there is anything left in the partnership, you are possibly due something, but how much is another matter. From the letter I read the administrators will be notified about each of you, but it won't hurt to contact them once you find out who they are.

                    From what I could gather Sunday Wealth Management has gone into compulsory liquidation you're unlikely to get much out of them. With legal help you may be able to get a court to agree to lift or "Pierce the Corporate Veil" which I understand means they would put to one side the company you were working for and look at the structure of any organisation underneath.

                    It does seem to rely on the court deciding that the purpose of the company was to defraud people in the first place.

                      My reply from insolvency.gsi.gov.uk

                      Thank you for your email. A winding up order was made against Sunday Wealth Management Ltd on 2nd December 2009 and the Official Receiver is the liquidator. The Official Receiver has been informed by Mr Andrew Nyiri, a director, that the company did not in fact ever trade and has no assets.. The Official receiver has been informed that there are other companies with similar names with which she is not dealing with..



                      If you consider you have a claim against the company please provide documentary evidence preferably with the company name and its Companies House Registration Number (05929062) in order that the matter can be investigated further.



                      There is an additional confusing factor in all this; the group of companies in which Mr Nyiri is a director uses a ‘brand name’ – Sunday Wealth Management, WITHOUT the ‘Ltd’ – at times and this is misleading many people into thinking that they are creditors of Sunday Wealth Management Ltd when in fact they are not. They may well be creditors of one of the other companies. They need to find out exactly who their payments were made out to.
