    No I don't think so HMRC came with three years in the full investigation and that is the basis of the investigation those three years only. Those are the years being fought over and discussed.

    To do any more needs a new investigation

      If it helps to reduce the worry then ask the accountant you have used if they have any MSC related investigation under way. File the reply very safe.

        Guys, I'm gradually getting my head around this stuff and firstly I'd like to say thanks to the guys on this forum who (presumably!) know a lot more than the likes of me and yet are still very generous with their time to respond and never with any sort of condescending attitude. I for one really appreciate it and I'm so glad I stumbled across this place.

        Could someone be kind enough to answer these please?

        1.When you talk about double taxation, do you mean being charged this PAYE tax when I have already paid CT and DT? And am I right in saying that despite putting in conditional claims, at present we don't know if this previous tax will be knocked off?

        2. If I wanted to pay on account and/or end up having to pay the bill, is it something I can do from the business? Or is this a personal tax meaning I have to be taxed again on what i take out and pay from my personal account? (If that makes sense).

        3. Boox filed appeals for 2 years of corporation tax. Nothing has been mentioned about claiming dividend tax as yet. Does this sound right and should I be doing something else?

        Before anyone says I should be asking Boox these questions they have now had their phone on divert for nearly two weeks and won't answer emails. Happy days!

          You don't seem confused at all

          1. Yes your CT and DT (and your employee NIC probably you
          ) should get knocked off. At the moment we don't actually know
          2. From your business if you can as it's your business who apparently didn't pay your employee's PAYE correctly. Though you can pay on account from your own funds just get the reference and get it ring fenced
          3. I think all experts are fairly relaxed about the DT as there is a longer time delay to get these claims in, CT was a bit of a panic.

          Sad to hear Boox have let you down now and then

            GregRickshaw I would like to say a massive thank you for your calm head on this.
            I've just had the 2018/2019 and 2019/2080 and NIC arrive. I've made my 1st POA on the 2017/18 Reg 80 and I will do the others tomorrow and the day after. (daily limit exceeded)
            I have a clearer head now I'm hoping that some of the DT and CT will be able to cover part of debt if we lose. Regarding the NIC I can't afford to make a POA nor did I get the options so the best I can hope for on that is a long TTP if we were to lose.

                Can anyone advise if pension contributions are taken into account by HMRC in their calculations?

                Only just discovered this thread but seems more like a tactic by HMRC to push people to brollies.

                  They appear to have disregarded them in my determination (hard to know they didn't provide any calculations).

                    I received a letter from HMRC to advise they will be sending the remaining determinations over the coming months. Has anyone else received this letter?

                    Also want to thank everyone who has contributed to this forum, is really a big help!

                      I’m pretty sure that whoever wrote this legislation never envisaged that a potential “MSC” would be paying a pension… it would seem to be an allowable expense from reading the legislation, though
